Terms & Conditions

1. Purpose

1.1. The purpose of these Terms and Conditions of Sale (hereinafter referred to as "TCS") is to regulate the rights and obligations of all parties involved in the online sale of sports training programs and/or other related services (hereinafter referred to as "Camp").

1.2. D&D Academy s.r.o. is the legal entity responsible for the International Tennis Camps (hereinafter referred to as the "Camps"), with its registered office at Na Radosti 486/55, Zlicin, 155 21, Praha 5.

1.3. By booking a Camp through this Website, the individual responsible for the booking (hereinafter referred to as the "Buyer") enters into a binding contract with D&D Tennis Academy s.r.o. and accepts all the provisions stated below.


2. General Provisions

2.1. These Terms and Conditions of Sale (hereinafter referred to as "TCS") govern the sale of Camp services related to the Camp program through the website https://www.international-tennis-camps.com/register/. The TCS form an integral part of the contract between the Buyer and the Seller of the services, namely the D&D Academy s.r.o.

2.2. By ticking the box "I accept the Terms and Conditions of Sale" prior to placing the order, the Buyer fully accepts and agrees to be bound by these TCS. The Seller, the Academy, reserves the right to modify the TCS at any time by publishing a new version on its website.

2.3. The applicable TCS are those in effect on the payment date of the order or the date of the first payment in the case of multiple payments.

3. Online Booking

3.1. If booking on behalf of a third-party minor, the Buyer certifies to either be the legal representative of the child or to have the consent of a legal representative of the child. For third-party bookings on behalf of adult or minor participants in the Camp program, the Buyer consents to the following:

3.1.1. Provide a first and last name as a reference during the booking process. The named individual must be at least 18 years old and is considered responsible for that specific booking.

3.1.2. Accept the TCS and assume responsibility for the booking on behalf of the participant(s) included in the booking.

3.1.3. Accept the responsibility for sending and receiving all communication (including modifications and cancellations of the booking) from the Academy or the Academy's suppliers relating to the booking, on behalf of all the participants included in the booking.

3.1.4. If the person responsible for the booking is not a participant, agree to provide the Academy, upon request, with the contact information of the participant stated in the booking, whom the Academy may contact to inform them of any changes, including cancellations or amendments to the booked Camp program.

3.1.5. Be entitled to a refund, if applicable, and ancillary costs or compensation related to the booking.

3.1.6. Confirm that all other participants stated in the booking may make subsequent changes to it, after answering the security questions regarding data protection and confirming their awareness and ability to do so. The Academy will not be liable for implementing modifications if consent has not been provided.

3.2. No minor participant shall be able to change the booking once it is finalized.


4. Description of the Programmes and Services

4.1. The Academy offers tennis camp programs that last 9 or 15 days depending on the category. A detailed description of the programs, including the type and number of hours of tennis and fitness training can be accessed on the Academy's website in the section "Current Camps".

4.2. Camps are organized into groups based on the Participant's tennis and fitness performance level, which will be evaluated by the Academy's coaches on the first day of the Camp.

4.3. The Academy agrees to fulfill the Participant's requirements for the duration of the Camp, specifically regarding tennis and fitness physical training according to the chosen plan during the time of booking.

4.4. The training schedule of the Camp, in terms of the number of hours for tennis and fitness training, as well as the timetable, is subject to change. The training schedule for each day of the Camp is communicated to the participants the evening before the daily training program or the morning before the daily training program starts.

4.5. Please note that prior to the first training session at the D&D Academy, we are not provided with detailed information regarding the skill levels of individual players. During the initial training, players are grouped based on age and subsequently assessed to determine their tennis proficiency.

While we strive to create balanced groups, we cannot guarantee that all players within a group will have the exact same tennis level. We understand that each player has unique abilities and areas of development.
Please be aware that the placement of players in groups is at the discretion of the Academy, and no refunds will be issued solely based on dissatisfaction with the assigned group. However, we assure you that the Academy always endeavors to place each player in a suitable and appropriate group based on their skill level and abilities.

4.6. The list of items included in the price of the camps can be found on Academy's website at https://www.international-tennis-camps.com/current-camps/.

4.7. The Academy offers additional services which are not included in the camp program. These services are available at an extra cost and are subject to availability. List of services offered for each of the camps available upon request. The Buyer can contact the Academy's staff via email at internationaltenniscamps@gmail.com.

4.8 The Academy is not responsible for arranging flights, visas and insurance to the Czech Republic.

4.8.1.The Buyer shall make the above arrangements themselves in a timely manner.

4.8.2. The Academy shall not be liable for any complications or missed deadlines that may be caused by the Buyer's failure to arrange airfare, visa and insurance.


5. Risk of Injury

5.1. The Participant, along with the Parent or Responsible third party, is responsible for ensuring that the Participant is physically fit and capable of participating in sporting activities. No refunds will be issued due to the Participant's inadequate physical fitness to engage in any part of the Camp.

5.2. It is important to acknowledge that the Camp involves physical activities that inherently carry a risk of accidents and injuries. The Participant, along with the Parents and/or Responsible third parties, assumes the responsibility to ensure that the Participant is in good health and does not have any medical conditions that may increase the risk of injury or physical harm. By confirming a Booking, the Participant and Parent or Responsible third-party consent to the possibility of reasonably foreseeable injuries that may arise from participating in Camp activities.

5.3. The Participant, Parents, or Responsible third party must inform the Academy of any physical or mental conditions that may require special attention or affect the Participant's ability to participate in the Camp. This information will enable the Academy to assess the Participant's suitability for the Camp and make any necessary reasonable adjustments to accommodate their physical or mental needs during participation.

5.4. If a Participant arrives at the Camp with an undisclosed or incompletely disclosed medical condition, or if the such condition becomes apparent during the Camp, or if the Participant's medical history has not been adequately disclosed to the Academy to enable an informed judgment regarding their fitness for the Camp, the Academy reserves the right to refuse the Participant's entry into the Camp program or require the Participant to leave the Camp, as deemed appropriate.


6. Medical Treatment

6.1. Participants, along with Parents or Responsible third parties, must not conceal any condition that may pose a significant risk during sports activities. Participants and/or Parents or Responsible third parties shall be held responsible for any such actions. Participants, Parents or Responsible third parties hereby grant authorisation to the Academy to take necessary actions in the event of hospitalization or surgery.

6.2. In the event of an injury sustained during sports activities at the Academy, the Academy will provide treatment to the Participant within the capabilities of its facilities. Injuries that occurred prior to the Camp, such as overexertion, fatigue, or general aches, do not warrant treatment by the Academy. Any necessary consultations with healthcare services for pre-existing injuries will be the responsibility of the Participant and billed accordingly.


7. Rules of Conduct

7.1. All participants are required to arrive on time for each training session.

7.2. The use of mobile phones on the court and in the fitness area is strictly prohibited.

7.3. Participants must change their training shoes before entering hotel facilities, cars and other places as specified by coaches of the Academy after training on clay courts.

7.4. Only authorised personnel are allowed in the tennis courts and other facilities during practice sessions. Parents or other accompanying third parties may consult with coaches for feedback after practice.

7.5. Interfering with practice by making comments, directly engaging with participants (players), or entering the courts is not allowed.

7.6. Any damage to or misuse of facilities, both on and off the courts, is strictly prohibited.

7.7. Violent, rude, or threatening behavior will not be tolerated and may result in termination of participation of the Participant from the camps.


8. Pricing and Invoicing Policy

8.1. The prices are stated in US dollars (USD).

8.2. The prices stated on the online booking form and related invoices include the applicable Value Added Tax (VAT) for the specific service.

8.4. The quoted prices for the Camps are not guaranteed until the full payment has been made.

8.6. To secure Camp bookings, payment must be made by the due date specified on the invoice.

8.7. Acceptable methods of payment are outlined in section 9 of the TCS.

8.8. Upon successful payment of the Camp, the Buyer will receive a Confirmation of Payment. Subsequently, the Academy will issue a Proforma invoice for the paid advance. Once the booked services are fulfilled, the Academy will provide the Buyer with the final invoice.


9. Terms of Payment

9.1. The list of accepted credit cards can be found at https://stripe.com/en-cz/legal/payment-terms.

9.2. The credit card will be charged for the total amount according to the terms of the placed order.

9.3. The credit card will be charged in the currency shown on the Proposal/Proforma Invoice and issued Invoice.

9.4. Your personal information, including your credit card details, is fully protected. The data transfer takes place on a secure server.

9.5. Refunds to the credit card are subject to the following conditions:

9.5.1. Refunds can be requested within the deadline defined in section 10 of the TCS.
9.5.2. Approved refunds will be processed in the same manner as the original payment.
9.5.3. In the event that it is not possible to charge the credit card, the Academy reserves the right to cancel orders.


10. Cancellation and Refund Policy

10.1. Cancellation and refund requests must be submitted in writing to the email address: internationaltenniscamps@gmail.com.

10.2. The cancellation policy for Camp programs is as follows:

10.2.1. If the Buyer cancels more than 90 calendar days prior to the start date of their respective Camp, they are entitled to a refund of 100% of the total Camp cost.
10.2.2. If the Buyer cancels more than 30 calendar days before the start date of their respective Camp, they are entitled to a refund of 50% of the total Camp cost.
10.2.3. If the Buyer cancels less than 30 days from the start date of the Camp, they are not entitled to any refund.

10.3. Severe or unfavorable weather conditions do not justify the cancellation of the booked Camp and do not warrant a refund. If outdoor training sessions cannot take place due to unfavorable weather conditions, the Academy will offer the Participant the option of playing on indoor courts. In such cases, the agreed-upon training volume may differ, and the Academy reserves the right to modify the Participants' schedules and allow more players per court than usual during a training session.

10.4. In the event of exceptional events or force majeure that make it impossible to continue with the booked Camp, the Academy is not obliged to refund fees already paid. However, the Academy will make every effort to find a satisfactory alternative to remedy the situation as quickly as possible.

10.5. The Academy reserves the right to remove any Participant who, in the opinion of Academy staff, is not physically or mentally capable of safely participating in the booked Camp program.

11. Complaints

The Academy strives to ensure the highest quality camp experience for its Participants. However, if you are not satisfied, please inform us at internationaltenniscamps@gmail.com.

Our dedicated staff will make every effort to address your complaint in a timely manner, within a maximum of 30 days.


12. Liability

12.1. The Academy, including its owner(s), director, employees, coaches, volunteers, officials, participants, agents, sponsors, owners/operators of the facilities where the programs take place, and representatives (collectively referred to as "the Academy"), shall not be held responsible for any injury, personal injury, accidents, damage, property damage, expense, theft, loss of income, or any other kind of loss or harm suffered by the Participant during or as a result of the programs, regardless of the cause, including negligence on the part of the Academy.

12.2. Participants are responsible for their own insurance coverage, including liability insurance. This applies to both program participants and their parents or accompanying third parties. Participants are also responsible for booking their flight and obtaining a visa to enter the Czech Republic.

12.3. Any damage to property that occurs during the Camp or while staying in the Academy will be the financial responsibility of the Participant, Parent, or other Responsible third parties.

12.4. All rights, including translations, reproductions, and reprints of training materials, even in part, are reserved. No reproductions may be made without the written permission of the Academy.


13. Personal Data Protection

13.1. The Academy processes the personal data of the Buyer and Participant, as well as the contact details provided during the online booking process, only when necessary for the provision of services, based on the legitimate interests of the Academy, or when the Participant and/or provided contacts have provided personal data or given consent for the processing of personal data.

13.2. Access to your personal information is limited to employees of the Academy. However, employees of legal entities that provide services and software support to us may also have access to personal data.

13.3. The Academy, represented by the company D&D Academy, s.r.o. with its registered seat at Na Radosti 486/55, Zlicin, 155 21, Praha 5, is responsible for the processing of personal data.

13.4. The Buyer and Participant have the following rights regarding the processing of personal data. To exercise these rights, please contact Academy employees via email: internationaltenniscamps@gmail.com.

13.6. The Personal Data Protection Agency can be contacted at Pplk. Sochora 27, 170 00, Praha 7, Ceska Republika (https://uoou.gov.cz/kontakt) for filing a complaint regarding the processing of personal data.


14. Data Processing Content

14.1. By booking the Camp program, the Participant, Parents, or Responsible third parties confirm that they are familiar with and agree to the terms of personal data processing and provide their consent as follows:

14.1.1. Consent to the staff of the Academy and third parties hired by the Academy to photograph or record videos of the Participant during their participation in the Camp program.

14.1.2. Consent for the employees of the Academy to use photographs and videos of the Participant taken by third parties during their participation in the Program.

14.1.3. Consent for the use of photos and/or videos of the Participant taken during their participation in the Camp program for promotional purposes without further consent, notices, consents, or fees. These photos or videos may be published on the Academy's own online channels (newsletter, website, Facebook, Instagram, and other social networks), print media, and third-party online channels (e.g., online newspaper portals).
The photos and videos will be made public for the necessary period of promotion and will be available to a larger audience during that period (visitors to web channels and shared channels). They may be used for promotional purposes multiple times, for a maximum period of 10 years. During this period, the videos and photos may also be used for internal purposes (monitoring business progress, tracking the Participant's progress, appearances, and attendance at events, etc.).

14.2. The data controller is the Academy, represented by D&D Academy s.r.o, The Academy will use photographs or videos of the Participant only as long as the Participant agrees to such use or the Academy has a legitimate interest in such processing. The Participant may withdraw their consent at any time, free of charge, by sending a written request via email: internationaltenniscamps@gmail.com.

14.3. However, even if consent is withdrawn, the Academy retains the right to continue processing the data if it has a legitimate interest.

14.4. The Participant also has other rights, including the right to object, the right to restrict processing, the right to erasure, the right to complain to the competent authority, etc.


15. Governing Law

These Terms and Conditions of Sale shall be governed by and construed in accordance with the laws of the Czech Republic. The parties agree to submit to the exclusive jurisdiction of the Mestsky soud v Praze, Namesti Republiky 1, 110 00 Praha 1, for any dispute arising out of or in connection with these Terms and Conditions of Sale.

16. Severability

If any provision or part of a provision of these Terms is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.

17. Miscellaneous

These TCS, together with any applicable Program TCS, constitute the entire agreement between you and D&D Academy relating to your access to and use of our Service. The failure of D&D Academy to exercise or enforce any right or provision of these TCS will not operate as a waiver of such right or provision. The section titles in these TCS are for convenience only and have no legal or contractual effect. Except as otherwise provided herein, these Terms and Conditions are intended solely for the benefit of the parties and are not intended to confer third party beneficiary rights upon any other person or entity.

18. The Academy reserves the right to modify the Terms and Conditions of Sale at any time without prior notice.

19. The Academy reserves the right to cancel the camp(s) up to 30 days before their start.
